Mere Confinement Cannot Stop Them -

A Look on Taiwan’s Disposal toward Rapist

Thesis Statement: This paper examines the wrong concepts of treating ex-convicts with records on rape which exist in common people’s minds and further discuss some of the loopholes in Taiwan’s current laws.

Outline:

. Recently, many rapes were done by ex-convicts who have just been paroled indicate that Taiwanese government have to develop effective disposals toward the highly risky rapists who are likely to commit crimes repeatedly as soon as possible.

. SVP (Sexually Violent Predator) is a hot issue in America, and American government has already set up several relative laws to protect the citizens. By contrast, there are many loopholes in our current laws and disposals which enable SVPs to recommit crimes.

. The penalties which Taiwanese government gives to the rapists are too slight in degree.

A. Our government condemns the rapists three to ten years of limited imprisonment, and it is easy to achieve the conditions of parole.

B. Short-term confinement is useless to SVP since it takes a long time to cure their mental problems.

C. Taiwanese authorities cannot effectively examine whether a criminal is dangerous to t the society but permit their application for parole, and this causes more rapes.

. Whether in Taiwan or other countries, physical and psychological treatments are regarded as useful disposals.

A. Physical therapy contains “Surgical Castration” and “Chemical Castration”.

a. “Surgical Castration” removes the testis and decreases the sexual desire.

b. “Chemical Castration” allows the injection of antiandrogen into muscle and control the abnormal imagination.

B. Neither of the two castrations is used in Taiwan. So far, the most usual therapy

our government uses is mental treatment.

a. Negative experiences in their early ages accumulate and result in the rapists’ violent behaviors so they need professional helps.

b. If a rapist is a SVP with “antisocial personality”, the therapy would become useless.

c. Unfortunately, those criminals who have no possibility of being cured have to be isolated from the society.

. Tracking the prisoners who are either released or paroled is important.

A. Last year, the Ministry of Justice started to let unconfined criminals to wear

electronic ring, but only few of them are qualified for this new rule.

B. We are exposed to dangers since we have no idea whether our neighbors are ex-convicts.

a. In 1994, United States Congress has passed “Megan Law” to protect their citizens from potential crisis, and the regulations differ from state to state.

b. Taiwanese government does not provide us such channels for self protection because some people claim that it might invade the rights of those criminals.

. All in all, mere confinement or extreme penalties cannot improve the problem of

rape. The authorities should take different disposals into account to effectively

build a safe society for women.

RP Firsthand Data Plan

I would like to collect my firsthand data through two ways:

1. Design questionnaire for classmates and friends to fill out. Perhaps I'll ask them how their opinions of the disposals toward the rapists

2. I want to know more about how our current laws deal with the rapists. And because my father recognizes some people who might be helpful, maybe he could arrange an interview for me.

RP Introduction

What They Need is Treatment Instead of Confinement
An American research indicates that, averagely, the probability for a female to be rapped during her lifetime is 13% to 44%. According to National Police Agency, the cases of compulsory sexual assault in Taiwan increases 299% from 1991 to 2002. However, the experts estimate that the real statistics must be 5 to 10 times higher than the official ones (qtd. in Hou 001). Rape has become a serious problem which threatens Taiwanese women. The way our government treats the rapists is to imprison them from months to years and then release them. It seems that we easily believe those rapists would regret while staying in the jail and would behave themselves after coming out. Still, to most rapists, especially serial rapists, simply putting them into jail cannot solve any problem. Their probability of committing crimes again after release is 100%. People tend to reckon what impels those rapists to assault women is the need of “sex”. Nevertheless, a report shows that one third of the rapists have mates or girlfriends. “The satisfaction of sex” cannot explain why they abandon normal ways and choose to attack innocent women (Chen 4). In consequence, what the government needs to do is to try to find out their real problems and let experts to offer them proper treatment while they are serving their sentences. Mere imprisonment is useless to those patients.
